Contractual Worker to get benefits, 13th month pay etc.

New Rule on Contractual Employment
Samuel P. Medenilla | Tempo, December 1, 2011

MANILA, Philippines – Amid the proliferation of companies outsourcing their services to contractors, the Department of Labor and Employment (DoLE) issued a new department order (DO), which will professionalize contractual workers.

Labor and Employment Secretary Rosalinda Baldoz said during a media forum Tuesday at DoLE’s head office in Manila at least 200,000 contractual workers from 2,624 contractors, subcontractors, and cooperatives will benefit from the new provision of Department Order No. 18-A, Series of 2011.

This will address the clamor of the labor sector to clarify government policy on contractual employment so that they could be assured this will not be used to circumvent the compliance of employers to labor standards - Sec. Rosalinda Baldoz said.

Under the DO No. 18-A, contractors, subcontractors and cooperatives are required to provide their workers with benefits similar to their regular counterparts. “The new D.O. will promote employment and encourage full compliance with minimum wages and general labor standards, including safe and healthful conditions of work, security of tenure, and self-organization and collective bargaining agreement,“ Baldoz said. It will also entitle them to social security benefits, which includes membership to SSS, Philhealth, and Pag-ibig.

The new order will also impose stricter requirements for contractors, subcontractors, and cooperatives to ensure only qualified companies will be able to operate. These include a P3 million paid capital to operate, possession of necessary tools and work prem ises to deliver their service, an employer-employee relationship with their workers, a PR25,000 registration fees, and the inclusion of a mandatory 10 percent administrative fee in their service contracts.

It will also require contractors, sub-contractors, and cooperatives to honor the full extent of the service contract with a company, which will prevent them from cutting the services of their workers in short periods per year. “These new provisions aim to weed out fly-by-night contractors and subcontractors. It will also end short term employment schemes like endo (end of contract) or 5-5-5 (five-month, fivemonth duration),“ Baldoz said.

She said the D.O. will become effective on Dec. 5, which is 15 days after it has been published in a national newspaper last Nov. 19. Companies, which will not be able to comply with these requirements, will have its licenses cancelled.

Mark Bautista tagged as the third party in the Piolo Pascual & KC Concepcion Break up?

Photo from Philstar
The controversial break-up of the showbiz couple Piolo Pascual and KC Concepcion left many people wondering why?  And think what's the real reason behind the couple's split-up?

And they were reading between the lines on the interview of KC in "The Buzz."

There was a persistent rumor from showbiz town that Mark Bautista was allegedly the third party in the Piolo Pascual & KC Concepcion break up.
Everybody has this giant question marks on their minds : Was he the real reason or not?

Mark Bautista is an actor and a singer. He's also the poster boy of Mang Inasal. He is Piolo’s co-member in the ASAP group Pop Icons@ ABS-CBN before he transferred to GMA 7. He was allegedly being linked to Piolo before Piolo and KC became sweethearts.

Fashion Pulis @ fashionpulis.com shares the grapevine on that crucial day when allegedly KC Concepcion was said to have finally seen the light -

A Post Mortem on the Interview

I am sure that many of you were glued to the November 27, 2011 controversial interview. According to a reliable source, this part of the interview was not aired:

Interviewer: Sino ba ang dahilan? Babae ba o lalaki?
Interviewee: No
Interviewer: Si M (make a wild guess) ba?
Interviewee: (umiling at umiyak)
When the network executive saw the full version of the interview, she specifically ordered this part to be cut.

Why was she hurting?

One day, when she came to his flat unannounced, his personal assistant (PA) told her that he was not there. She did not believe the PA so she marched directly to his bedroom. She was shocked when she saw that he and the other guy just came out of the shower. She left the country after witnessing this incident.

Where are they now?

The two of them are currently in Japan for a show. When he heard that her interview was going to be aired, he immediately changed the line up of his songs.

What could possibly have made KC say on national television in that interview with Boy Abunda on The Buzz:

” PJ knows exactly why we broke up. He knows exactly why.”

“May mga bagay na hindi ko na kayang lunukin, hindi ko na kayang tanggapin…”
(there are some things I can no longer take and accept….)

Mang Inasar: Hahanap hanapin mo kesa ke PJ

And here’s what Piolo said when interviewed by ABS-CBN upon his arrival from Japan where he did a show with fellow ABS-CBN talent Enchong Dee, Kaye Brosas,KC Concepcion and the allegedly cause of the break-up Mark Bautista.

"I apologize to the public for the break up and both of us are undergoing personal crisis"-Piolo Pascual
